Registration

To access certain features of our Marketplace, Candidates must create an account by providing accurate and complete information. Employers must also create an account and are bound by these Terms upon account creation.

Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Account Termination

Fika AI reserves the right to suspend or terminate your account at our discretion, including for violations of these Terms.

Authorized Representative Warranty

By creating an Employer account on the Marketplace, any individual (e.g., employee, recruiter, agent) acting on behalf of an organization or third party represents and warrants that they are duly authorized to bind that organization to these Terms.

Employer Representative Responsibilities

• They have the necessary authority and legal power from their organization (or from themselves, if they are an independent recruiter) to use the Marketplace and enter into agreements under these Terms.
• They will use the Marketplace in a manner consistent with the interests and policies of the represented organization, if any.
• They are responsible for any actions taken on the Marketplace under their account, including compliance with all applicable laws and non-discrimination policies.

Permission to Share Data

• As a Candidate, you agree Fika AI may share your profile and personal data (including CV, contact details, and AI interview data) with Employers and potentially with external entities for recruitment purposes.
• As an Employer, you agree that any Candidate data you obtain through the Marketplace will be used solely for legitimate recruitment and hiring purposes, in compliance with all applicable laws and regulations.
• Fika AI may share Employer data (e.g., name, logo, company description) with Candidates on and outside the Marketplace for recruiting purposes and may use Employer names/logos on our website for marketing.

Consent to Communication

All Users agree that Fika AI may contact them via email, SMS, or phone regarding recruiting purposes, employment opportunities, feedback requests, employer branding, service updates, or any other relevant purpose.

Email Introductions: As part of our recruiting services, Fika AI may introduce Candidates and Employers to each other via email (or other direct communications). By using the Marketplace, you consent to receiving or sending such introductions and to the sharing of any relevant details necessary for the introduction.

1. Direct Employment Obligations

If you (the Employer) hire a Candidate for your own organization, you are solely responsible for all employment-related obligations, including but not limited to wages, payroll taxes, insurance, and employee benefits.

2. Recruiters and Staffing Agencies

Client's Obligations: If you are a recruiter or staffing agency using the Marketplace on behalf of a third-party client, that client (as the ultimate hiring entity) is responsible for all employment-related obligations under applicable law.

Your Ongoing Responsibility: Your obligation to pay Fika AI's fees and to comply with these Terms remains in effect regardless of your client's status or actions. Nothing in this subsection absolves you of any other liabilities or responsibilities set forth in these Terms.

3. Fika AI as an Intermediary

Fika AI acts solely as an intermediary providing a platform and tools to connect Candidates and Employers. Under no circumstances shall Fika AI be considered an employer or co-employer of any Candidate. The Employer (or its client, if the Employer is a recruiter/staffing agency) bears all responsibility for compliance with labor, employment, and related laws.

User Conduct

All Users agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations.
• Providing false, misleading, or incomplete information during registration or in posted content.
• Uploading or posting unlawful, harmful, or defamatory content.
• Attempting to interfere with Marketplace security or integrity, including unauthorized access to other accounts or data.
• Posting job openings or other materials that are discriminatory, deceptive, or violate employment laws.
• Data Extraction: No one may scrape or copy data from the Marketplace except for their own information; automated or manual data-scraping is prohibited.

11.1 Accuracy of Profiles

Fika AI does not verify the accuracy of any content (e.g., resumes, job postings). Information provided on the Marketplace is the sole responsibility of the party providing it.

11.2 No Guarantee of Employment Outcomes

Fika AI provides a platform for recruitment but does not guarantee job offers, successful hires, or suitability of Candidates. Hiring decisions remain the Employer's responsibility.

11.3 Equal Opportunity and Non-Discrimination

Employers must comply with all equal opportunity, anti-discrimination, and harassment laws. Fika AI is not liable for discriminatory actions by Employers. We reserve the right to suspend accounts that violate non-discrimination policies. Employers remain responsible for interpreting AI outputs in a fair, non-discriminatory manner.

Scope

Candidates and Employers agree not to circumvent or bypass Fika AI in any manner that avoids payment of fees due under these Terms.

Restrictions

• An Employer may not hire or engage a Candidate introduced or sourced via Fika AI without paying the applicable fee.
• A Candidate may not work, directly or indirectly, for an Employer introduced through Fika AI outside of Fika AI's fee structure.

Termination and Fees

If Fika AI discovers any form of non-circumvention, we may terminate the offending account immediately, and the Employer will be liable for a fee equal to twice the amount Fika AI would have received otherwise.

13.1 Ownership of Marketplace Content

All non-user-generated content on the Marketplace (text, graphics, etc.) is owned by Fika AI or its licensors and is protected by law.

13.2 Ownership of User Content

By uploading or submitting any content, you retain ownership of intellectual property rights in that content.

13.3 License Grant

You grant Fika AI a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content for:

• Operating the Marketplace
• Providing services
• Marketing your content to potential Employers or Candidates
• Promoting and redistributing part or all of the Marketplace

13.4 Representations and Warranties

You warrant that you have the necessary rights to grant Fika AI the above license and that your content does not violate any laws or third-party rights.

13.5 Content Standards

User Content must not be unlawful, defamatory, obscene, harassing, or otherwise objectionable. Fika AI may remove or modify any User Content that violates these Terms.

13.6 Feedback

Any suggestions or feedback you provide regarding the Marketplace are deemed non-confidential, and Fika AI may use them without restriction.

14.1 Arbitration Agreement

You and Fika AI agree to settle any disputes by binding arbitration under the rules of the Arbitration Institute of the Stockholm Chamber of Commerce (SCC).

Before arbitration, parties may attempt voluntary mediation. Arbitration will occur in Stockholm, Sweden, in English, unless otherwise agreed. The arbitrator's decision is final.

14.2 Exceptions

Either party may seek relief in a small claims court for disputes within the scope of that court's jurisdiction. Nothing in these Terms prevents either party from seeking injunctive relief or other equitable remedies for intellectual property or unauthorized access issues.

14.3 Waiver of Jury Trial

You and Fika AI expressly waive any right to a trial by jury in any action or proceeding arising out of or relating to these Terms.

19.1 Termination by You

You may terminate your account at any time by emailing team@joinfika.ai.

19.2 Termination by Us

Fika AI may suspend or terminate your access at its discretion, including for violations of these Terms.

19.3 Effect of Termination

Upon termination, your right to use the Marketplace and services ceases immediately.
